Terms and Conditions of the Online Store

Online store operating at:
www.hogga.pl
is run by Ineo Mateusz Stachowski, REGON 387345584, NIP 6981729458, with the main address of business: ul. Osiedle Piaskowe 32, 62-023 Borówiec hereinafter referred to as “Seller”.

§.1 General provisions

  1. Contact with the Seller can be obtained:
  • by phone: +48 603 807 419 (the Store’s working hours are 8.00-17.00 on working days Mon-Fri, the fee is the same as for a regular phone call, according to the tariff package of the service provider used by the Customer),
  • by email to: office@hogga.pl
  • via the contact form on the website.
  1. The following meaning of words is established:
  • CONDITIONS – these Regulations,
  • CUSTOMER – a natural person, a legal person, or an organizational unit without legal personality, but with legal capacity, who, under the terms of these Regulations, places an Order in the Online Store,
  • Consumer – A customer who is a natural person using the Online Store for purposes not directly related to his/her business or professional activity,
  • GOOD, PRODUCT – a movable item, presented in the Online Store, to which the Sales Agreement applies,
  • SALE AGREEMENT (AGREEMENT) – a contract of sale of sale Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, using the website of the Store,
  • ONLINE SHOP (SHOP) – internet service available at the address

    through which the Customer may place an Order,
  • ORDER – a declaration of will of the Customer specifying unambiguously the type and quantity of Goods, aiming directly at the conclusion of the Sales Agreement.
  1. Sales are made via the Internet between the Orderer as Buyer and the Store as Seller.
  2. Each customer purchasing products offered by the Store is obliged to familiarize himself with the content of these Regulations.

§.2 Orders

  1. Information about the assortment available in the Store constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.
  2. By placing an Order, the Customer makes an invitation to conclude a contract of sale of the ordered products in the Store. The process of ordering a product begins with confirmation of the benefit features through the product page. The customer is informed about product availability, price and payment methods, as well as possible delivery options. In order to deliver the product, the customer is required to provide his address information or verify it in case of previous account registration and purchase after logging in. Before placing an order, the Customer confirms that he/she has read these Terms and Conditions, along with consent to the processing of personal data for the purpose of processing the Order.
  3. The order confirmation sent by the Store to the e-mail address provided by the Customer constitutes a statement of acceptance of the invitation mentioned above. If the Customer terminates the service and leaves the Store before the Order is confirmed, the contract will not be concluded.
  4. Goods are shipped within 24 hours of placing an order. In the case of any logistical difficulties related especially to the shipment of bulky products, the Seller will contact within 24 hours after the purchase to agree on the date of delivery of the goods. 
  5. A customer purchasing as an entrepreneur is required to provide a tax identification number (TIN) when placing an order, otherwise it is assumed that he is purchasing as a Consumer.
  6. In order to place an order, the Customer is required to select from among the available in the Store: the ordered Products, the method of delivery, the form of payment and indicate the delivery address. The selection is made by: selecting the Product and adding it to the shopping cart.
  7. If the products covered by the Order are unavailable in the warehouse, at the Store’s suppliers or for other reasons and it is not possible to carry out the Customer’s Order, the Seller will immediately inform the Customer of this fact no later than within 48 hours, counting from the date and time of placing the Order. In this case, the customer has the right to decide whether he agrees to fulfill the Order within the timeframe proposed by the Store, or to withdraw from the contract. If it is not possible to fulfill a part of the order, as mentioned above, the customer is informed about the status of the order and decides how to fulfill it. In the case of exceptional situations related to the availability of goods, the maximum time limit for delivery of goods is 21 days.

§.3 Product price and payment methods

  1. The price listed next to each Product is binding at the time the Customer places the Order. The prices of goods posted on the Store’s website include VAT.
  2. Delivery of Goods is carried out through courier companies DPD, UPS, POCZTEX, DHL, AMBRO. Information about the cost of delivery is available in the process of placing an Order before it is placed.
  3. Delivery costs will be included in the prices of the products depending on the goods ordered and the delivery method selected by the Customer when placing the Order.
  4. The Seller provides the Customer with the following methods of payment for the Products:
      • traditional bank transfer,
      • electronic payments by means of the system HERE NAME AND DATA OF ELECTRONIC PAYMENTS SYSTEM.
      • cash on delivery PLEASE CONFIRM

§.4 Warranty, claims and complaints

  1. The Seller provides a written 5-year warranty on all Products sold in the Store. The warranty is only valid if the product is properly cared for and used in the specified humidity only in indoor conditions. Imperfections resulting from the natural and diverse nature of wood and imperfections related to manual production are not subject to warranty and complaint.
  2. If the delivered Goods are found to be defective, the Customer may, at his option, exercise his warranty rights and his rights from the Seller under the warranty. Warranty rights and warranty rights are independent of each other.
  3. In the case of contracts concluded with Consumers and Entrepreneurs with consumer rights, the Seller shall be liable under warranty and/or contractual liability for services rendered. It is excluded with respect to the customer with the remaining status.
  4. In case of defects in the delivered Product or provided services, the Customer may file a complaint and inform the Store about the observed irregularities, document the irregularities in order to verify the objections and indicate whether he demands repair, replacement of the Goods with new ones. Complaints can be submitted electronically after sending the complaint protocol. It is possible to solve the complaint problem on a component delivery basis. Complaints are processed within 14 days of receipt of notification from the Buyer. It may be necessary to send the goods back to the Seller. If it becomes necessary to transfer the goods to the Seller – he has a period of 7 days to respond to the complaint after receiving the advertised goods.
  5. Exclusions and product information:
    • Complaints are not subject to differences in the color of the wood associated with color change in the aging process, drying of the wood or wear of the coating.
    • Complaints are not subject to minor scratches and cracks in the wooden material resulting from the natural drying of the wood.
    • Wooden elements are made with a length and width tolerance of +/- 2mm.
    • The geometry of steel frames may vary slightly and insignificantly due to the handmade nature of production.
    • There may be faint blemishes on steel parts due to welding technology and manual individual production.

6. In the event of a dispute between the Store and the Customer as to the legitimacy of the refusal to consider the complaint, the Customer, who is a Consumer, has the right to use out-of-court means of handling complaints and claims. The customer can use mediation or amicable justice by providing the institution before which the proceedings will be held with the appropriate form – a request for mediation or a request for consideration of the case before an amicable court. A list of sample institutions with contact information is available at www.uokik.gov.pl. In addition, at http://ec.europa.eu/consumers/odr , the consumer has access to resolve consumer disputes electronically through the EU online platform (ODR platform). Such a right is not available to an Entrepreneur with consumer rights.

Informing about the right to withdraw from the contract

Only the Customer who is a Consumer is entitled to a 14-day withdrawal period. According to Art. 22 (1) of the Civil Code, a Consumer is defined as a natural person making a legal transaction with an entrepreneur that is not directly related to his economic or professional activity.

Right of withdrawal

You have the right to withdraw from the purchase contract within 14 days without giving any reason. The deadline for withdrawal from the contract expires after 14 days from the day on which you took possession of the item or on which a third party other than the carrier and indicated by you took possession of the item.

Returns are possible only for unused products. As a rule, returned goods must return to us intact, with no signs of use.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (sent by e-mail).

Refunds are made only after the Seller evaluates the returned goods – no later than 7 days after receipt of the return, the Seller confirms acceptance of the return and transfers the due amounts to the Buyer.

§.5 Final provisions

  1. The applicable law is Polish law. Disputes arising between the Customer and the Seller will be resolved by the court having jurisdiction over the Seller’s registered office, with the proviso that with respect to Consumers, these disputes will be resolved before the competent court according to the rules of civil procedure. These Regulations shall be governed by and construed in accordance with the laws of Poland. These Terms and Conditions do not limit any consumer rights to protection that you may be entitled to under the mandatory laws of your country of residence.
  2. The Seller reserves the right to change the Terms and Conditions by announcements on the Website (and to maintain and provide archival versions). The Seller will notify registered Customers of the change in the Terms and Conditions by e-mail with the right to terminate the contract within 14 days. Amendments to the Regulations shall become effective 14 days after notification. Orders placed before the effective date of the amendments to these Regulations shall be processed on the basis of the provisions in force on the date of the Order.
